Winter 2024
Dear Clients & Friends:
A lot is happening in the world of work. The US Supreme Court’s recent opinion in Murray v. UBS lessened the standard of proof required for a Sarbanes-Oxley whistleblower claim to a need to show that a claimant’s protected activity was “a contributing factor” in his termination, rather than requiring proof of retaliatory intent by the employer. On a local level, the U.S. Department of Education’s Office of Civil Rights is investigating Drexel University, Rutgers University, Lafayette College, and the University of Pennsylvania over allegations of antisemitism and Islamophobia following the start of the Israel-Hamas conflict.
